Provisional Tax Deadline

The Provisional Tax Deadline: Don’t Get Caught ⏰

Most salaried South Africans wrapped up filing season back in October, but if you’re a provisional taxpayer or a trustee, your deadline is still ahead of you ⏰

The key date is 22 January 2027: the deadline for individual provisional taxpayers and trusts to file their income tax return for the 2026 year of assessment. It’s one of the most misunderstood dates in the tax calendar, so let’s be crystal clear about what it is, and, just as importantly, what it isn’t.

📆 What the 22 January deadline actually is

This is a return-filing deadline, not a payment deadline. By 22 January 2027, individual provisional taxpayers and trusts must submit their income tax return (the ITR12 for individuals, the ITR12T for trusts) for the 2026 tax year, via eFiling.

Non-provisional individuals (most salaried employees) had an earlier deadline of 23 October 2026. Provisional taxpayers and trusts get the extended window to 22 January, but “more time” has a way of disappearing fast 😅

⚠️ Don’t confuse it with your provisional tax payment

This is where people trip up, so it’s worth spelling out. Your provisional tax payments are a completely separate obligation, on different dates:

📅 First provisional payment (IRP6): end of August (31 August 2026 for this cycle)

📅 Second provisional payment (IRP6): the last business day of the tax year, 26 February 2027 (28 February is a Sunday)

📅 Optional third top-up payment: around end-September

So you have two different things running: the return (ITR12/ITR12T) due 22 January, and the second payment (IRP6) due end-February. Missing either has consequences, and they’re not the same deadline 🎯

👤 Who must file by 22 January?

The 22 January return deadline applies to individual provisional taxpayers and trusts, broadly:

💼 Sole proprietors and freelancers

🏢 Company directors with significant non-salary income

🏘️ Individuals with meaningful rental income

📈 Individuals with substantial investment income

🏛️ Trusts, whose filing season runs 19 September 2026 to 22 January 2027

If you’re not sure whether you’re classified as a provisional taxpayer, that’s worth checking, the obligations differ (see our provisional tax guide).

⚠️ What happens if you miss the filing deadline?

Late filing of your return isn’t a gentle matter:

📈 Administrative penalties — recurring monthly penalties for late/outstanding returns, from R250 up to R16,000 per month depending on your income

💸 Interest on any tax owed

🤖 Estimated assessments — SARS can raise its own assessment without your deductions

🔴 A knock to your compliance status, which matters for your tax compliance PIN

❓ I’m a trust, is anything different for me?

The 22 January deadline is the same, but trusts have extra requirements: the ITR12T, mandatory supporting documents (trust deed, financial statements, resolutions), and the enhanced beneficial-ownership declaration. We’ve covered this fully in our trust filing season guide, and crucially, every trust must file, even dormant ones 🏛️

❓ Do I still owe a provisional payment if I file my return in January?

Yes, remember, they’re separate. Filing your ITR12 by 22 January does not settle your second provisional payment, which is due by the end of February. If your estimate was too low, the February payment is also where the 20% underestimation penalty can bite. So January is about the return, and February is about the payment, plan for both 📊

❓ What if I can’t gather everything in time?

File accurately with what you have rather than not filing, a late return is worse than an imperfect one you can correct. But the better move, if you’re stuck, is to get help fast: a tax practitioner can pull your third-party data, sort your documents, and file correctly before 22 January, even at short notice ⏱️

🎯 Two deadlines, one plan

The 22 January filing deadline and the end-February payment deadline are close together and easy to confuse. Which is exactly why provisional taxpayers and trustees benefit from handling them as one coordinated plan rather than two last-minute scrambles.

Go2 Accounting handles returns and provisional tax for business owners, trusts and individuals across Pretoria. ITR12/ITR12T filing, accurate IRP6 estimates and deadline management, so nothing slips through. Get in touch well before 22 January.

Because with SARS, knowing which deadline is which is half the battle 😉
